Limited Warranty

Simmons Manufacturing Company will replace or refund purchase price to the original purchaser of this product if it is determined that the same is defective. This warranty is limited to replacement of the product or refund of the purchase price.

Limited Warranty – Import Products:

Simmons manufacturing Company will replace or refund purchase price to the original purchaser of this product if it is determined that the same is defective up to maximum of one year from the date of purchase. This warranty is limited to replacement of the product or refund of the purchase price.

Exclusions of Warranty:

Simmons will make no warranty, express or implied, with respect to its products, other than the limited warranty described above. Implied warranties of merchant-ability and fitness for a particular purpose are hereby disclaimed by Simmons unless such disclaimers are prohibited by applicable state law. There are no warranties that extend beyond the description on the face hereof.

Exclusion of Incidental and Consequential Damages:

In no event shall Simmons be liable for incidental or consequential damages, including, but without limitation, damages for personal injury or property damage, it being intended that purchaser’s exclusive remedy is limited to replacement of defective products or refund of purchase price.

Exclusions for Improper Use or Installation by Unqualified Persons:

The limited warranty provided by Simmons will not apply if a Simmons product is used for a purpose other than the purpose for which it was manufactured, which is as a component in cold water systems only. The limited warranty provided by Simmons also will not apply if a Simmons product is improperly installed or is installed by an unqualified person. Simmons products should be installed only by licensed contractors or by persons having proper training and experience in the installation of water systems and water system components. Simmons products should not be used in water systems which may exceed the maximum working pressure indicated on the product or product literature. It is the installers responsibility to make sure the product and product installation meet all local, state and federal code regulations.

Warnings:

Improper use or installation of Simmons products may cause property damage or personal injury. Simmons products should be used in cold water systems only. Simmons products should not be used in water systems which may exceed the maximum pressure indicated on the product. Simmons products should be installed only by licensed and qualified persons.
